Terms of Service

These Terms of Service (“Terms”) govern your access to and use of StudyingNurse (“we,” “us,” or “our”) and its exam-preparation platform, including practice questions, rationales, study tools, and subscription plans (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account and purchase a subscription. By using the Service you represent that you meet this requirement and that the information you provide is accurate.

3. Accounts and Security

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Accounts are for individual use. You may not share, resell, or transfer your account or access to others.
• Notify us promptly at support@studyingnurse.com if you suspect unauthorized use of your account.

4. The Service

StudyingNurse provides nursing exam-preparation content, including NCLEX-RN, ATI, and HESI practice questions with teaching rationales, organized into a guided study path with progress tracking and a missed-questions review bank.

We release content by exam and topic as each set completes review by a licensed nurse. Status labels on the site indicate what is available now and what is forthcoming. We may add, modify, or remove features and content over time to improve the Service.

5. Subscriptions and Billing

• Plans and pricing. Paid plans, their durations, and prices are shown at checkout. Prices are in USD unless stated otherwise.
• Payment processor. Payments are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your chosen payment method.
• Renewal. Plans are sold for a fixed period (for example, 30 or 90 days) and do not automatically renew. When the period ends, access stops unless you choose to purchase again. You will not be charged automatically.
• Cancellation. You may cancel at any time from your account settings or by contacting support. When you cancel, your access continues until the end of the period you have already paid for, after which it stops. We do not charge you again.
• Price changes. We may change prices; changes apply to future billing periods and we will give reasonable notice before they take effect.

8. Intellectual Property

All content on the Service — questions, rationales, study materials, design, and software — is owned by StudyingNurse or its licensors and is protected by copyright and other laws. We grant you a limited, personal, non-transferable, non-exclusive license to access the content for your own exam preparation. You may not copy, reproduce, distribute, publish, scrape, resell, or create derivative works from any part of the Service without our written permission.

9. Acceptable Use

You agree not to:

• Share, resell, or redistribute account access or content
• Use automated tools to scrape, copy, or download content
• Attempt to bypass paywalls, access controls, or security measures
• Reverse-engineer or interfere with the operation of the Service
• Use the Service for any unlawful purpose or in violation of these Terms

We may suspend or terminate accounts that violate these rules.

10. Disclaimer of Warranties & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, StudyingNurse will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of or inability to use the Service. Our total liability for any claim arising from your use of the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, with or without notice depending on the severity. On termination, your right to use the Service ends; sections that by their nature should survive (intellectual property, disclaimers, limitation of liability) will continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised version with a new “Last updated” date and, for material changes, provide reasonable notice. Continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
